Additional $533K Settlement for Family of Child Killed in Car Crash

The family of a six-month old boy who was killed in the crash of a car that was being driven by his 23-year-old nanny in 2011 in Aberdeen, N.J., has reached an additional $533,503 settlement in the case with a second automotive service station which had previously worked on the car, and with the nanny’s estate.

The infant, Gabriel Bauder, and his nanny, Janine Hayes, died following the crash on Sept. 6, 2011, on Church Street, according to a March 31 story by NJ.com. Gabriel’s three-year-old brother, William, was also hurt in the crash and was left with permanent injuries, the story states.

The Bauder family filed a lawsuit in connection with the case, alleging that two vehicle service stations had not properly advised the family about excessively worn tires on the 2004 Pontiac Sunbird automobile that Hayes was using to transport the family’s children, the story reported.

The family originally reached a $1.6 million settlement with B&G Gulf in Holmdel, N.J., back in 2015 in the case, but newly-reached settlements have been announced, including $249,497 from STS Tire in Hazlet and $283,503 from Hayes’ estate, pushing the total award to about $2.13 million, the story reported.

“Severely worn rear tires contributed to the crash,” according to the lawsuit filed by the family, while a mechanic at STS Tire previously had recommended only replacing one tire when the car was in for service, the story states. B&G Gulf, which previously settled the case with the family, also allegedly failed to tell the Bauders about the condition of the tires, according to the report.

Another car, a 2007 Jeep Commander, was also involved in the crash, but none of the three occupants of that vehicle were injured, according to a Sept. 8, 2011 story on NJ.com.

The infant, Gabriel Bauder, died several hours following the crash after suffering severe head trauma, according the story reported. Hayes suffered trauma to her head, chest and abdominal injuries and died instantly, according to the report.
